The draft Fund Risk Limitation Act

Original: “Der Entwurf zum Fondsrisikobegrenzungsgesetz”

On August 8, 2025, the German Federal Ministry of Finance published the draft Fund Risk Limitation Act. This marks a new attempt to implement the European requirements of the AIFM Directive II into German law. Changes will be made in particular to the German Investment Code. This article examines the changes from the perspective of German-registered and fully regulated AIF capital management companies.
