Discussion Draft of the Federal Ministry of Finance on the Global Minimum Tax - An Overview

Following the adoption of the EU Directive on the implementation of a global minimum taxation at the end of 2022, a first draft of the national implementation law was published by the Federal Ministry of Finance on March 20, 2023. The so-called Minimum Tax Directive Implementation Act is thus the preliminary result of a year-long finding process at the level of the OECD with the so-called Inclusive Framework on BEPS, the EU and the Federal Republic of Germany. This article will provide an overview of the new global minimum tax and then critically assess selected aspects of the draft law.
